HB0002 - Disposition of water rights
This appears to be coming from the Wyoming State Board of Controls and Senator Hicks to address “orphaned water rights”. Mainly this is related to irrigation and that water being attached to land to be subdivided. When subdivision occurs and there are not ditch or pipeline easement to get the water to the properties each lot can’t legally get water. I guess they are trying to get something that says you either get water to each property or the water right needs to be dealt with. We also believe a few options for the subdivider exist: 1. Abandon the water right. 2. Detach the water right which eventually will mean loss of the right after some time. 3 Give water and rights to the new lots with easements and such. 4 Move the right to somewhere else (including city or town).

On August 11, 2017 the WYOPASS Board submitted proposed language and a memo regarding the Extraterritorial Jurisdiction language.
Extraterritorial Jurisdiction Proposed Language
On May 18, 2017 WYOPASS Board Members Charles Bloom and Derek Teini attended the Joint Corporations, Elections and Political Subdivision Interm Committee meeting in Laramie and presented a letter (link above) requesting a seat at the table for WYOPASS to work with Legislature on extraterritorial jurisdiction. WYOPASS was granted the request and will begin work with WCC, WAM, and other interested parties to draft a bill for the 2018 sessions using SF0017 as a starting point.
